These Terms and Conditions (“Terms”) govern your access to and use of https://peacefullyaligned.com, related pages, forms, payment option pages, content, Human Design reports, charts, guided sessions, recordings, uploaded materials, mentoring, coaching, resources, and other Human Design coaching services provided by Imagine It! LLC, an Arizona limited liability company (“Imagine It!,” “Imagine It! SAS,” “we,” “us,” or “our”).

Peacefully Aligned Human Design is a public-facing Human Design coaching and mentoring brand, program, or offering operated by Imagine It! LLC. These Terms apply to Peacefully Aligned Human Design and to any additional Human Design products, services, programs, reports, sessions, resources, bundles, or related offerings made available by Imagine It! LLC.

By accessing the website, submitting a form, providing birth information, uploading materials, purchasing or requesting an offering, scheduling or attending a session, receiving a report, or otherwise interacting with our Human Design products or services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website or services.

1. Eligibility and Adult-Only Services

The website and Human Design coaching services are intended for adults age 18 and older. We do not offer Human Design coaching services to minors. By using the website or services, you represent that you are at least 18 years old and are able to enter into a legally binding agreement.

2. Scope of These Terms

These Terms apply only to Human Design products and services offered by Imagine It! LLC, including Peacefully Aligned Human Design and future or additional Human Design products and services. These Terms do not govern non-Human Design services that Imagine It! LLC may provide now or in the future unless those services expressly link to or adopt these Terms.

3. Nature of Human Design Products and Services

Our Human Design products and services are intended for self-discovery, education, reflection, personal growth, and personal or professional development. Human Design content is interpretive and reflective in nature. It should not be treated as a guarantee, prediction, diagnosis, prescription, or directive for life decisions.

Our Human Design products and services are not medical advice, mental health treatment, therapy, legal advice, financial advice, crisis support, or licensed professional advice. Our services do not create a physician-patient, therapist-client, attorney-client, financial advisor-client, or other licensed professional relationship.

You are responsible for your own decisions, actions, relationships, career, finances, health, wellbeing, and life choices. You should consult qualified licensed professionals for medical, mental health, legal, financial, or other professional concerns. If you are experiencing an emergency or crisis, contact emergency services or an appropriate crisis support resource immediately.

4. Faith-Based Perspective and Spiritual References

Peacefully Aligned Human Design services are designed to support individuals who are open to faith-based reflection, including belief in God, a Supreme Being, Higher Source, divine guidance, or similar spiritual concepts.

From time to time, our Human Design coaching, reports, sessions, written materials, communications, or related resources may include references to God, divine purpose, spiritual alignment, inspiration, prayerful reflection, or similar faith-based concepts. When such references are used, they are offered from the perspective of a belief in God or a Higher Source and may be informed by a Latter-day Saint faith perspective.

These references are intended to support reflection, meaning-making, and personal growth. They are not intended to impose religious belief, provide religious instruction, replace ecclesiastical counsel, or represent the official doctrine, position, or endorsement of any church, religious institution, or faith organization.

Clients are responsible for discerning whether the faith-based perspective of the services aligns with their own beliefs, values, and personal comfort. If you prefer not to receive faith-based references or spiritual framing during a session, you may let us know, and we will make reasonable efforts to honor that preference where consistent with the nature of the service.

5. Offerings, Products, Bundles, and Pricing

We may offer Human Design products, reports, charts, sessions, bundles, limited-time offers, introductory pricing, custom journeys, resources, or other related services from time to time. Specific descriptions, pricing, availability, bonuses, included features, and fulfillment details may be presented on the website, in a payment flow, in a form, in written communications, or in a separate service-specific agreement.

Current or future offerings may include, without limitation:

·          “Intro to You” Complimentary Chart — a basic one-page Human Design snapshot or summary.

·         “Intro to You” Full Report — a self-guided Human Design report based on information submitted by the client.

·         “Intro to You” Guided Basic Review Session — a guided session to walk through chart or report information.

·         “Intro to You” Guided Basic Review Bundle — a bundled report and session offering.

·         “Getting to Know You” Guided Series — a multi-session introductory series that may be offered with limited-time, introductory, or bundled pricing from time to time.

·         “Deeper Dive” Guided Session — a focused session around selected Human Design topics.

·         Customized Mentoring & Coaching Journey — a custom journey subject to discussion, pricing confirmation, and mutual agreement.

·         Additional or future Human Design products, packages, resources, or services.

Descriptions, pricing, availability, bonuses, launch pricing, and included features may change at any time. Unless we clearly state otherwise, changes will apply only to future purchases, bookings, or offerings and will not affect services that have already been confirmed. We are not required to continue any specific product, bundle, discount, launch price, or offer indefinitely.

6. Soft Launch and Certification Status

These Terms do not include a specific representation regarding certification status. Human Design services may be offered as part of a new, introductory, limited, or soft-launch offering period.

7. Complimentary Chart and Self-Guided Report Limitations

The Complimentary “Intro to You” Chart is intended as the most basic starting point. It may provide a one-page summary or snapshot, but it does not include a full explanation, personalized walk-through, deeper interpretation, or detailed application to your life. To understand how Human Design themes may apply personally, a full report or guided session may be recommended.

The “Intro to You” Full Report is a self-guided resource and does not provide the same personalized insights, interactive discussion, or one-on-one interpretation that may occur during a guided walk-through session.

8. Birth Information and Client Information Accuracy

Human Design chart preparation may require accurate birth date, birth time, and birth location (“Birth Information”). You are responsible for providing complete and accurate Birth Information and other information requested for the service. Inaccurate or incomplete Birth Information may affect chart generation, report content, session preparation, or interpretation.

If you do not know your exact birth time, you should disclose that clearly. We may still provide general information, but the accuracy and usefulness of certain chart elements may be limited. Our collection, use, retention, and disclosure of Birth Information and other personal information is described in our Privacy Policy.

9. Forms, Payment Options, and Order Flow

You may be asked to complete a service selection form before payment. The purpose of the form is to collect the information needed to identify the offering selected, prepare any chart or report, coordinate scheduling, and guide you to the appropriate next step.

After submitting the form, you may be directed to a payment options page where you can choose how to fulfill payment. Submission of a form does not guarantee acceptance of an order, session, or appointment until payment, confirmation, scheduling, or other required steps are completed, as applicable.

By submitting a form or completing payment, you agree to these Terms and our Privacy Policy, and you acknowledge that Human Design services are for self-discovery, education, reflection, and personal growth and are not medical, mental health, legal, financial, therapeutic, crisis, or other licensed professional advice. You also acknowledge that Human Design chart preparation may require Birth Information and that our handling of Birth Information is described in our Privacy Policy.

10. Pricing, Payment Methods, and External Payment Platforms

Prices are listed on the website, in payment instructions, in written communications, or in custom offering confirmations. Prices may be changed at any time, but changes will not affect orders already confirmed unless otherwise agreed.

We may accept payment through Venmo, Zelle, personal check, or other payment methods we choose to offer in the future. Electronic payments are completed through external, third-party payment platforms. Our website does not collect or store PCI cardholder data, and we do not collect full credit card numbers, debit card numbers, or similar payment credentials directly through the website.

Third-party payment platforms are governed by their own terms, privacy policies, fees, security practices, and processing rules. We are not responsible for third-party payment platform errors, outages, declined payments, delays, reversals, disputes, or user mistakes.

For personal check payments, services may not begin, reports may not be generated or delivered, and sessions may not be confirmed until payment has cleared, unless we expressly agree otherwise in writing. For custom mentoring or coaching journeys, please do not submit payment until we have confirmed the custom structure and pricing.

11. Scheduling, Rescheduling, and Missed Sessions

Guided sessions, deeper-dive sessions, mentoring, coaching, and custom appointments are subject to scheduling availability. Sessions may be conducted virtually through Microsoft Teams, Zoom, or another agreed format.

You are responsible for attending scheduled sessions on time. If you miss a session, fail to attend, or cancel late, the session is forfeited unless we decide otherwise. Any refund, credit, or rescheduling may be provided at Imagine It! LLC’s sole and absolute discretion.

Multi-session packages, including a 3-session package, must be used within six months of purchase or another written start date confirmed by us. Unused sessions remaining after the expiration period may be forfeited unless we agree otherwise in writing.

12. Cancellation and Refund Policy

Refunds may be available before work begins, but not after a report is generated, chart work begins, session preparation begins, a digital product is delivered, or a session occurs. Because reports, charts, digital products, recordings, session preparation, and coaching services may involve personalized preparation and reserved time, all sales may be final once work has begun or materials have been delivered.

Digital products, including reports, charts, recordings, downloads, PDFs, worksheets, or other digital materials, are non-refundable once delivered unless we decide otherwise.

All refunds, credits, or rescheduling may be provided at Imagine It! LLC’s sole and absolute discretion. For custom mentoring and coaching journeys, cancellation, payment schedule, refund, expiration, and rescheduling terms may be set out in a separate written agreement or confirmation.

13. Session Recordings

Sessions may be recorded by default with notice. You may ask that a session not be recorded, and we will make reasonable efforts to honor that request unless recording is required for a specific service purpose that is disclosed to you. If you do not want a session recorded, you should make that request before the session begins.

You may not record any session without our prior written permission. This includes audio recording, video recording, screen recording, transcription, automated note-taking, AI meeting capture, screen scraping, screenshotting, snipping, photographing, capturing images of speakers or participants, capturing images of shared screens, or otherwise preserving session content by any manual, automated, or technological means.

Session recordings, transcripts, chats, screen shares, screenshots, images, notes, and related materials are for personal and private use only unless we expressly agree otherwise in writing.

You may not copy, distribute, publish, post, sell, share, upload, train AI systems with, or otherwise make available any session recording, transcript, chat, screen share, screenshot, image, speaker or participant image, report, chart, worksheet, or related material without our prior written permission. Our handling of session recordings and related personal information is further described in our Privacy Policy.

14. Client Uploads and Prohibited Sensitive Information

You may be able to upload, email, or otherwise submit files, documents, images, worksheets, screenshots, or other materials. You are responsible for ensuring that you have the right to submit any materials you provide and that your submissions do not violate the rights of any third party.

Unless specifically requested and necessary for a defined service purpose, you should not submit medical records, mental health records, financial account information, government identification numbers, passwords, third-party confidential information, or other highly sensitive information. We may delete or decline to review materials that we believe are inappropriate, unnecessary, unsafe, unlawful, or outside the scope of our services.

15. Client Responsibilities

You agree to:

·         Provide accurate, complete, and current information, including accurate Birth Information when requested.

·         Use the website and services only for personal, lawful, and appropriate purposes.

·         Participate respectfully in sessions, communications, and service interactions.

·         Make your own decisions and seek qualified professional support when needed.

·         Complete payment, scheduling, forms, and other required steps in a timely manner.

·         Not misuse, copy, resell, distribute, publicly post, train AI systems with, or commercially exploit our reports, charts, recordings, worksheets, content, or other materials without written permission.

·         Not submit prohibited sensitive information unless specifically requested and necessary for a defined service purpose.

·         Comply with these Terms, the Privacy Policy, and any service-specific terms or written agreements.

16. No Guarantees or Specific Outcomes

We do not guarantee any particular personal, professional, emotional, relational, financial, health, spiritual, business, or life outcome from using the website or services. Results and experiences vary by individual. You remain responsible for your decisions, interpretations, actions, and results.

17. Intellectual Property and Personal Use License

The website and its content, including text, graphics, branding, logos, layouts, product names, service descriptions, reports, charts, worksheets, recordings, downloads, resources, frameworks, and other materials, are owned by or licensed to Imagine It! LLC and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use purchased or delivered materials for your own personal, non-commercial use. You may not reproduce, distribute, publish, sell, modify, create derivative works from, train AI systems with, share paid materials with others, or commercially exploit our materials without prior written permission.

Your personal reflections, personal journal entries, or original materials that you create remain yours. However, Imagine It! LLC owns its website content, reports, charts, worksheets, recordings, frameworks, templates, educational materials, branding, and service materials, except for third-party materials or tools owned by others.

18. Testimonials, Feedback, and Marketing Use

We may use general feedback to improve our services. We will not publicly use your testimonial, name, image, likeness, recording, identifying story, or other identifying client details for marketing purposes without your permission. Any testimonial or marketing use should be subject to separate consent or release, and counsel should review testimonial and endorsement practices.

19. Privacy

Our collection, use, retention, and disclosure of personal information, including Birth Information, session notes, recordings, uploads, payment-related information, website analytics, and newsletter information, is described in our Privacy Policy. Please review the Privacy Policy before submitting information, uploading materials, attending sessions, or purchasing services.

20. Third-Party Tools, Links, and Services

The website and service process may include links to or integrations with third-party tools and service providers, including payment processors, Venmo, Zelle, scheduling platforms, Microsoft Bookings, Microsoft 365, Microsoft Teams, Microsoft Copilot, Zoom, Human Design chart applications, email newsletter tools, analytics tools, website hosting tools, social media websites, artificial intelligence tools, automation tools, and other technology platforms that may become available or useful in the future.

We may use artificial intelligence tools or automation tools to support business operations, website administration, content development, service preparation, organization, communication, documentation, or other internal purposes. When using AI tools, we make reasonable efforts to avoid entering personal information, Birth Information, client session details, uploaded materials, or other confidential client information into tools that use submitted data to train their models, unless we have provided notice, obtained any required consent, or determined that the use is otherwise appropriate and permitted by applicable law.

We do not control and are not responsible for third-party websites, platforms, tools, services, terms, policies, data practices, model-training practices, outages, security, or availability. Your use of third-party tools may be governed by the third party’s own terms, privacy policy, data processing terms, and AI or machine learning policies.

21. Website Availability and Changes

We may update, modify, suspend, or discontinue any part of the website or services at any time, with or without notice. We do not guarantee that the website or services will be uninterrupted, error-free, secure, or available at all times.

22. Prohibited Uses

You agree not to:

·         Use the website or services for unlawful, fraudulent, harmful, abusive, harassing, or misleading purposes.

·         Attempt to gain unauthorized access to the website, systems, forms, data, accounts, or service providers.

·         Interfere with website security, functionality, or availability.

·         Upload or transmit malicious code, spam, or harmful content.

·         Misrepresent your identity or submit false information.

·         Copy, scrape, reproduce, resell, or exploit website content or service materials without permission.

·         Use the services to infringe the rights of others or disclose information you do not have the right to disclose.

·         Record, distribute, publish, or share session content or materials without written permission.

23. Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, reports, charts, sessions, recordings, mentoring, coaching, and related services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise. Imagine It! LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Counsel should review this section for enforceability.

24. Limitation of Liability

To the fullest extent permitted by law, Imagine It! LLC and its owners, members, managers, representatives, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, personal decisions, professional outcomes, emotional distress, or other damages arising from or related to your use of the website or services, even if advised of the possibility of such damages.

To the fullest extent permitted by law, Imagine It! LLC’s total aggregate liability for any claim arising out of or relating to the website, services, reports, charts, sessions, recordings, materials, or these Terms will not exceed the amount paid for the specific service giving rise to the claim, or $100, whichever is greater.

If any limitation, exclusion, or cap on liability in this section is found to be invalid, unlawful, or unenforceable, then that limitation, exclusion, or cap will be modified and enforced to the maximum extent permitted by applicable law. If a court or other decision-maker determines that a different liability cap is required, the parties agree that liability will be limited to the lowest amount permitted by applicable law. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

25. Indemnification

You agree to defend, indemnify, and hold harmless Imagine It! LLC and its owners, members, managers, representatives, contractors, affiliates, and service providers from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, your misuse of the website or services, your violation of law, your infringement of third-party rights, your submissions or uploads, your unauthorized recording or distribution of materials, or information you provide.

26. Binding Mediation; Class Action Waiver; Governing Law; Venue

Before filing any lawsuit or formal legal proceeding, the parties agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the services through binding mediation administered by a mutually agreed mediator or mediation service. The parties will participate in good faith. The mediator’s decision or mediated resolution will be binding to the fullest extent permitted by applicable law, subject to any rights or procedures that cannot be waived by law. Counsel should confirm the desired meaning and enforceability of “binding mediation,” including whether arbitration rather than mediation is intended.

To the fullest extent permitted by law, you and Imagine It! LLC agree that any dispute will be brought only on an individual basis and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative action. Counsel should review this class action waiver for enforceability.

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, except where prohibited by applicable law.

Subject to the dispute resolution process above and unless applicable law requires otherwise, any legal action arising from these Terms or the services shall be brought in the state or federal courts located in Maricopa County, Arizona.

27. Force Majeure

Imagine It! LLC will not be liable for delay or failure to perform due to events beyond reasonable control, including acts of God, illness, emergencies, internet or platform outages, payment processor outages, scheduling platform outages, labor disputes, governmental actions, natural disasters, war, terrorism, civil unrest, utility failures, or other circumstances beyond reasonable control.

28. Termination or Refusal of Service

We may suspend, terminate, or refuse access to the website or services if we believe you have violated these Terms, misused the services, failed to pay required fees, engaged in inappropriate conduct, created risk for Imagine It! LLC or others, or requested services outside the scope of our offerings. Any refund, credit, or rescheduling in such situations will be determined according to these Terms and applicable law, and may be provided at our sole and absolute discretion.

29. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date indicates when the Terms were most recently revised. Continued use of the website or services after updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by law.

30. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

31. Entire Agreement

These Terms, together with the Privacy Policy and any written order confirmation, custom coaching or mentoring agreement, payment terms, or service-specific terms, constitute the entire agreement between you and Imagine It! LLC regarding the website and Human Design products and services.
